President Hassan Sheikh Mohamud has invalidated the National Independent Elections Commission and the Federal Boundaries Commission and instructed the cabinet to establish new Election Commission and a new Federal and Border Commission.
The President said the two bodies were unprocedurally constituted as provided for by articles of the Provisional Constitution which lays the framework for the formation of independent commissions.
Articles 111 E and 111G of the Provisional Constitution establish the Boundaries and Elections Commissions respectively.
According to the Presidential decree, the Upper House of the Federal Parliament was not involved in the composition of the two bodies in 2020.
Article 71 of the Provisional Constitution dictates that the Upper House shall take part in the formation of independent commissions following the submission of nominated persons by the Council of Ministers.
